What is received date? What is delivered date? How come there are 6 days gap between those days? Even if you assume that the receiving guy took 6 days to lift his hand and receive, how come the received date is before the delivery date? So he received it even before it was delivered to him.

Guys - I asked my lawyer about the predicted time frame of my case which is EB3 ROW priority date of October 2005. I asked specifically if my case would be approved in a matter of months or years. They said that my case would most likely take years!
I don't really understand how the process works - how could it be years when my priority date is only 4 months away. Does anyone have any explanation why this would be the case.
This lawyer has been great for me and I trust what they say but I am not sure about the prediction - if anyone could shed any light on this I would be so grateful.

thanks for your supportive words for CP filers now CP filers need some relief as they are not able to get an EAD/AC21. I think we could ask to allow CP filers to file 485 with out having dates current and conserdering their CP filing date to get EAD and AC21.

Dude you can convert from CP to AOS even after filing for CP. Your CP can be canceled. Vise-versa is more complicated. Even murthy.com had some write up on this. Go search their website.
Talk to a lawyer and stop cribbing here. Your situation is nothing different from others.

Well, everyone wishes the rumour to be true.
But you know what, to realize the increase in fees for the I-485, they should allow people to file for it. Unless people start filing for I-485's they are not going to make the $2billion in 2 yrs. If retrogression continues, guess the fee increase doesn't make much sense.... Not sure whether I am right or wrong here.

There are good and not so good schools here for MS /PhD. Either way why a seperate quota for US MS/PhD. Is a foreign MS/PHD any inferior?

That was a good account for those who haven't been to an Infopass. The procedure is near about the same where I usually go too.
I think that the AP info that you got is good...but the serendiptious (!) info of your and your family's NameCheck status bears good info/benefit in the longer term.
As for the 4 months thing, she is right if we go by FBI stat papers and testimonies given over the past few years; but what I find most interesting is that 7 out of the 8 people who I personally know, and who filed with me in June still have their NC pending as of this week. That does not include me whose NC is pending for past 4.5 months (since my info was sent to FBI!).
So the dataset is small but challenging. I am sure there are many like me. Wonder why I find many whose NC is pending in the 4-6 month range and very few (of the 68% - per FBI) whose have got it cleared in the so called 48-72 hours (after the info is sent to FBI) ! :confused:

No FP notices. Spoke with the lawyer today morning and he mentioned that as the FPs are elgible for 15 months, they issue the FP when they "think" that they shall be able to finish the case in that 15 month time period.
My EADs say FP not available, but I believe that it is not a big concern.
Now that my EB3 PD is Sept 2001, I am hoping to get the FPs sooner rather than later.
As for I-485 Reciept Notice's receipt date, will check with lawyer again and update you folks on that.

Can you or somebody tell me the nature of RFE that was issued after invoking AC21. Was it related to semilar/same job category or ability to pay or educational qualification etc etc.

I have seen many people in the forums getting RFE after invoking AC21. You know how USCIS works, right?? If they ever keep track of what they are doing and if they have a definite process in place, neither there will be any retrogression nor any of these forums. Be prepared for RFE if you are invoking AC21. Though you can survive that, imagine the period between receiving the RFE and responding to it. What if that happens in your 5th or 6th year of wait?? I pray that your wait is not that long.

To mailmy_gc : You are very lucky to have it on the 100th day i guess..Mine is pending 98 days and i went to local office - Newark, NJ today and they told me your file is with the IO and you are probably struck in background check - cant understand he spend 90+ days on background check alone! and i am still counting. I met atleast 3 people whose EAD is pending and expired and are counting days. I cant beleive USCIS is no ruthless and care a damn about legal immigrants.
Can anyone tell me how else i can expediate? - I already tried 2 Info pass, one service request, Letter to CIS ombustman (they did respond with rrecommendation). I havent contacted senator (does it help - if so do i just call them or go to there office?). Any input will help.

Senators Specter and Leahy have offered the Habeas Corpus Restoration Act as an amendment to the bill; and Senators Durbin, Hagel, and Lugar are planning to offer the DREAM Act as an amendment. Call your senators now and urge them to vote YES on these amendments!
